Terms & Conditions
DEFINITIONS
LayerSpace: a privately owned service which provides website building tools, image gallery hosting, interactive image selection tools, online selling (e-commerce) facilities and various other related services.
User: person or persons who have subscribed to services provided by LayerSpace.
Member: person or persons who have subscribed to services provided by LayerSpace.
By signing up for a LayerSpace account, users agree
to be bound by these terms and conditions
LayerSpace reserves the right to change these terms and conditions at any time.
Any violation of these Terms & Conditions may result in the termination or suspension of a user's account, with or without warning, at the sole discretion of LayerSpace.
The following terms apply to the use of LayerSpace services
1. Pornographic, obscene, graphically violent, and other inappropriate content is strictly prohibited.
2. Offensive and/or indecent Gallery, Text page and 'Space' names are not allowed and will be blocked and/or removed.
3. LayerSpace is not responsible for the content of any member's website.
4. LayerSpace reserves the right to remove any websites, 'Spaces' and/or Galleries that are in violation of our terms and conditions.
5. Members will be held legally responsible for the content of their websites for, but not limited to, use of copyrighted material without the permission of the author or posting material considered indecent for minors.
6. The use of LayerSpace websites for illegal purposes is strictly forbidden and offending websites will be removed without notice.
7. LayerSpace membership will be revoked if any of the following is considered by LayerSpace to be active:
a/ Adult or Pornographic content
b/ Hate, Bigotry, and/or Intolerance
c/ Sale or promotion of Warez or software piracy
d/ Music piracy
e/ Hacking related subjects
f/ Sale or promotion of copyrighted software which has been "cracked" (ie copyright protection for the software has been removed)
g/ Sale or promotion of serial numbers for software which can be used to illegally validate or register software.
h/ Sale or promotion of tools which can be used for "cracking" software.
i/ Spamming to promote a website
j/ Anything related to illegal activity.
k/ Sale or promotion of images for which copyright is not owned or permission from the copyright owner is not granted.
l/ Sale or promotion of programs, software or music files.
8. No program, software or music file may be stored on or uploaded to our servers.
9. LayerSpace reserves the right to remove Content which is deemed in LayerSpace's sole discretion harmful, offensive, or otherwise in violation of these Rules or any rules, terms or policies LayerSpace has in place at the time.
10. LayerSpace will not be liable for any of its services.
11. LayerSpace has the right to cancel the service at any time, and will not be liable for any files that are lost and/or corrupted which may occur from a system crash or hard disk failure.
12. To the full extent permissible under the applicable law, LayerSpace shall not be liable for any direct, indirect, incidental, special or consequential damages resulting from the use of or inability to use LayerSpace services.
13. All LayerSpace websites will display a small text link to www.layerspace.com.
TEMPLATES
14. All templates offered by LayerSpace are copyrighted material.
15. Templates are offered for use by LayerSpace members under license only, and are not offered for sale or unlicensed use.
16. Such license limits use of LayerSpace templates to sites hosted by LayerSpace.
17. LayerSpace templates may not be transferred to or hosted by another web host or Internet Service Provider.
ADULT OR INAPPROPRIATE CONTENT
18. Pornographic, obscene, graphically violent, and other inappropriate content is strictly prohibited.
19. LayerSpace will treat all abuse violations on a case by case basis and the decision of LayerSpace will be final and binding.
20. Contemporary nude "art" may be acceptable under certain circumstances but if any images in this category become the subject of a complaint, they will become unacceptable content.
21. Any text which describes, refers to, or alludes to services, stories, or products of an adult or sexual nature is a violation of our terms.
Other inappropriate content includes:
22. Graphically violent images not specific to the context of the site
23. Graphically violent content that is not computer generated for gaming purposes
24. Hate speech directed toward an individual or group of people based on sex, color, creed, practices, or orientation
25. Content depicting or referring to the harm of others, animals, or property
26. Content depicting violent behavior toward others or oneself
HACKING RELATED CONTENT
Any text, imagery or information relating to the following is a violation of our terms:
27. Unauthorized use, or attempts to circumvent or bypass the security mechanisms of an information system or network.
28, Unauthorised access to a computer, its files and programmes.
29. Usage, creation, or distribution of tools or programs intended to alter or enhance the experience of a game or program opposed to the intended use or function of that game or program.
CANCELLATION/REFUND POLICY
30. A member or LayerSpace may terminate the member's Account at any time for any reason.

31. No penalty shall be imposed for cancellation of an account.
32. No refund shall be due in the event of cancellation by either LayerSpace or a member.
DELIVERY/ACCESS POLICY
33. Upon successful setup of subscription payments by a member, immediate access will be granted to the member's LayerSpace account. This will be indicated by email message.
34. Access to a member's account shall be continous subject to each recurring payment being made.
32. In the event of payment failure, access to a member's account shall be suspended until such time as payment is made.
33. If payment is not completed within 30 days of being due, LayerSpace reserves the right to cancel the account and take appropriate action to recover the amount outstanding.
REPORTING CONTENT VIOLATIONS
If you find a site hosted by LayerSpace which is in violation of the above terms, please report the site to LayerSpace including the following:
The site owner's username if known
The URL of the page(s) that contains the content in question
The specific location of the violation on the page(s)
The nature of the violation
Please email LayerSpace to report the violation.
REPORTING COPYRIGHT VIOLATIONS
If you believe that a site hosted by LayerSpace is in violation of copyright held by yourself, your company or organisation, please report the site to LayerSpace including the following:
The site owner's username if known
The URL of the page(s) that contains the content in question
The nature of the violation
A description of the content
The location of the site from which the content has been stolen (if applicable)
The date of creation of the original content
Please email LayerSpace to report the violation.
